SIA and its suppliers, partners, and licensors may make available such Materials through the Website and other Services. The Materials are provided solely for educational and informational purposes. The Materials may contain errors in facts or information from time to time. Before you act in reliance on any facts or information in any Materials, you should confirm any facts that are important to your decision. SIA makes no representations or warranties as to the reliability, accuracy, timeliness, usefulness, or completeness of any Materials or any facts, content, information or data contained therein. SIA matches associations to preferred Brokers who are licensed as property and casualty insurance brokers in Florida (and other states), and is compensated for its services by a licensed broker (not by the association). SIA does not market, sell, issue, or service insurance policies, and is not responsible for the insurance that an association purchases. 

SIA is not responsible for, and has no control over, the content of any such Association Materials, Third-party Materials or Insurance Materials that may be provided or accessible through our Services. You understand that SIA cannot, and does not, guarantee or warrant that the Materials, from any source, that are available for access or downloading through this Website or the Services are or will be free of errors or defects, contain complete and accurate information or are or will be free of infection, viruses, worms, Trojan horses or other code or defects that contain or incorporate contaminating or destructive properties. 

Third-party Materials. 

The Website and Services may contain certain downloadable materials provided by outside third-parties and vendors, such as, but not limited to, insurance carriers, insurance brokers and/or agents (“Third-party Materials”). 

Permitted Use of Third-Party Materials. End Users shall have the right to use these Third-party Materials solely for use in connection with their registered End User role and for business and institutional purposes. These Third-party Materials may not be sold, licensed, leased or used to create derivative works except as expressly permitted in writing by SIA. 

SIA-owned Content and Materials. 

The Website and Services contain certain materials and content developed by SIA that may be available for downloading and use by users, such as, but not limited to, insurance information, insurance premium information, and.or other records. These materials are posted publicly on SIA’s Website and are available for use by users for personal use only. Other SIA-owned content that is available to certain registered users may include, but are not limited to, board education and training materials, and other documents related to certain associations in connection with their registered End User role, and personal, business and institutional purposes. 

RESTRICTIONS ON USE. 

You acknowledge that this Website, the Services, the Materials and any underlying technology used in connection with this Website and/or the Services, including all software, material, information, graphics, animations, audio, video, photos, and other data, available on this Website or through the Services provided by SIA, its licensors, vendors or approved third-party providers, are the copyrighted works of SIA or such third parties. Except for the permitted uses expressly stated above, you may not use, copy, distribute, republish, resell, upload, post or transmit any Materials without the prior written consent of SIA. Modification of the Materials for any purpose may violate SIA, or a third party’s intellectual property rights. The Materials provided on the Website and through the Services are provided for use in accordance with the permitted uses set forth above and lawful purposes only. 

USER SUBMISSIONS. 

All personally identifiable information, including, but not limited to, first name, last name, mailing address, email address and telephone number (collectively “PII”) and content, designs, ideas, graphics, or other information that you send to us or otherwise make available through this Website or the Services (together, the “Submissions”), is and remains your property. SIA’s practices relating to the use and protection of any PII provided to SIA through the Website are detailed in SIA’s Privacy Policy (as described below). You consent to SIA’s collection, use, storage and transmission of such Submissions, including any PII, for SIA’s Business Purposes and activities (as such terms are defined in our Privacy Policy).

SIA has taken reasonable and appropriate steps and has employed industry-standard practices and technology to ensure the integrity and confidentiality of personally identifiable information (PII); but because even the most secure computer system can be violated, SIA cannot guarantee absolute security. Information Provided Directly by You. 

You actively provide information to SIA in various ways while using our Services. For example, you share information when you:

Information Provided By Potential Clients to Request a Proposal. 

Individuals, communities, associations or other organizations seeking to more information about SIA’s insurance program may submit a request for additional information, by using SIA’s Contact Us link on the Website. Users will be required to submit the name and zip code of their association/community, their first and last name and email address and may elect to provide their telephone number, street address, city, state, number of units, need for on-site services and a personal message. 

Supplemental Information Provided While Using the Services. 

Supplemental information may be requested and provided by users through the Services to facilitate the offering of Services and functionality requested or purchased by you or the Association Client for which you are an authorized End User of, including the following: 

  • User Data and Information includes information that we obtain or receive from you, related to the SIA Association Client of which you are an authorized End User, information related to SIA Association Client associations, communities and organizations, information related to the homeowners that reside within the SIA’s Association Client’s associations,  communities and organizations, as well as permanent records and other Association Materials provided by you or a SIA Association Client. 
  • We may collect and process the User Data uploaded or provided by you, in order to provide the Services requested or purchased by you, or the SIA Association Client for which you are an authorized End User of. 
  • Handling contact and support requests. If you send us an email through our “Contact Us” link to request user support, or if you contact us by other means including, but not limited to, via phone, we process your personal information to the extent it is necessary for our legitimate interest in fulfilling your requests, providing the Services to you and communicating with you. 

Providing and Promoting our Website and Services and its Security. 

We process your personal information by tracking your use of our Services, creating aggregated non-personal data, verifying accounts and activity, investigating suspicious activity, and enforcing our terms and policies to the extent it is necessary for our legitimate interest in promoting the safety and security of the Services, and in protecting our rights and the rights of others.

From time to time your personal information, such as your name, phone number, email address or mailing address, may be used to contact you with SIA promotional materials, newsletters, information pertaining to your homeowners association, or other information that may be of interest to you based on your preferences. You may be contacted by the phone number or e-mail address you provide to us. We may contact you in this way based on our legitimate interest in undertaking marketing activities to provide you with the most up-to-date information on our Services and other products and services you may be interested in based on your preferences. By providing your contact information you have opted-in to receive direct marketing and commercial information by means of allowable electronic communications. You can withdraw your consent to receive any direct marketing communication from us by emailing info@insured-by.com or following the unsubscribe instructions in our email communications. 

Non-Personal Information. 

We collect and create de-identified and aggregated information and other non-personal information, which is not related to an identified or identifiable natural person (“Non-Personal Information”). You agree that SIA owns, without restriction, all Non-Personal Information and that you have no rights in or to any Non-Personal Information. Because Non-Personal Information cannot be used to personally identify you, you agree we may use such information for any lawful purpose. 

HOW WE SHARE YOUR INFORMATION: 

Generally. 

We do not sell, share, or otherwise transfer your personal information to third parties, except for sharing your personal information with our third-party service providers and partners in furtherance of SIA’s Business Purposes as described below. We may also share your personal information when we believe sharing is necessary to comply with applicable law, enforce our policies, or protect our or others’ rights, property, or safety. 

We may share your personal information with other trusted third-party companies and individuals to provide and improve the Services, facilitate and complete transactions, requested services, process payments, analyze use of our Services, perform analytics and produce statistics on the Services, or deliver other requested services and features to you. These third-party service providers may include, but are not limited to, payment processors, insurance service providers, insurance brokers, agents and carries, and mail/parcel delivery service providers. These third-party service providers are contractually bound to only process the limited personal information we provide them to perform specific tasks at our direction. These third-party providers are bound to maintain the personal information they receive from SIA in accordance with this Privacy Policy. 

As a general rule, beyond the uses set forth above that assists us in carrying out SIA’s Business Purposes and provide the Services requested by you, we will not sell your personal information to third parties without your permission.

To the extent needed, we may still keep some of your data to ensure we comply with your request to limit processing, or for other legal purposes.

INFORMATION RETENTION: 

SIA has a legal duty to keep various records, for different periods of time, depending on their content and the state to which they pertain. SIA will retain your personal information only for so long as is necessary to implement, manage, and provide the services requested by you or the Association Client, or as required to comply with our legal and regulatory requirements, rules and obligations, which may vary based on the state in which you reside. When SIA no longer needs, nor is no longer required to maintain the information, SIA will remove it from its system. 

SECURITY: 

SIA uses technical, administrative, and physical measures to protect your personal information against accidental or intentional destruction, loss, alteration, unauthorized disclosure, or access and against other unlawful forms of collecting and processing. SIA follows industry standards and practices to help protect the confidentiality and integrity of your personal information that is collected and processed. Data Security and Privacy Protocol 
Technical and Organizational Measures 

The technical and organizational security measures (“TOMs”) and controls implemented by SIA Insurance Agency, Inc. (“SIA”) to protect Customer Data, including personal data and ensure the ongoing confidentiality, integrity, and availability of SIA’s products and services are described herein. SIA may, from time to time, make changes to these security measures and controls, but in so doing will not materially weaken its protection of Customer Data. 

  • Information Security Governance. 
    • SIA maintains dedicated staff responsible for the development, implementation, and maintenance of SIA’s information security program. 
    • SIA implements a set of policies for information security that are defined, approved by management, published, and communicated to personnel and relevant external parties. 
    • SIA regularly reviews the policies for information security at planned intervals or if significant changes occur to ensure their continuing suitability, adequacy, and effectiveness. 
    • SIA implements audit and risk assessment procedures for the purposes of periodic review and assessment of risks to the SIA organization, monitoring and maintaining compliance with SIA policies and procedures, and reporting the condition of its information security and compliance to executive management. 
    • SIA values the confidentiality of information and adheres to requirements for confidentiality or non-disclosure agreements reflecting the organization’s needs for the protection of such information are identified, regularly reviewed, documented, and enforced. 
  • Information Security Training. 
    • SIA requires that new personnel complete security awareness training as part of the on-boarding process. 
    • SIA ensures that all employees of the organization and, where relevant, contractors receive regular, but at least annually, and appropriate awareness education and training and regular updates in organizational policies and procedures, as relevant for their job function. 
    • Employees and, where relevant, contractors complete regular, but at least annually, data protection training as relevant for their job function. 
  • Data Protection.  
    • SIA engages in information assets classification to classify information in terms of legal requirements, value, criticality and sensitivity to unauthorized disclosure or modification.
    • SIA maintains identified, documented, and implemented acceptable use standards of information, the assets associated with the information, and information processing facilities.
    • SIA storage media is disposed of securely, ensuring data is rendered unrecoverable, when no longer required or prior to reuse, using formal procedures.
    • SIA has an established access control policy which is, documented, and reviewed based on business and information security requirements. The controls include:
      • Access controls for workspaces,
      • Access controls for IT systems, and
      • Access controls for apps and data.
      • SIA actively engages in security controls which include logical segregation of data, restricted (e.g., role-based) access, monitoring, and where applicable, utilization of industry-standard encryption technologies.
      • SIA actively engages in data security controls for requesting, approving, revoking, and revalidating user access to systems and applications. Only personnel with clear business need will be provided access to systems and applications with personal data.
      • SIA has a designated Network Systems and Security Director.
      • Employees receive work instructions and guidelines regarding confidentiality and data protection as relevant for their job, to ensure compliant handling of personal data.
      • Sub processors and service providers are carefully selected and are bound to SIA’s processing restrictions. Incidents are notified to SIA without undue delay.
    • Technical Security Controls.  
      • SIA implements detection, prevention, and recovery controls to protect against malware, combined with appropriate user awareness.
      • SIA regularly scans to detect technical vulnerabilities and apply appropriate mitigation actions to reduce the associate risk and exposure to such vulnerabilities.
      • SIA regularly patches and updates, in a timely manner, systems and applications based on the severity of identified vulnerabilities.
      • SIA monitors various information sources to ensure knowledge of and response to relevant threats.
      • SIA networks are managed and controlled to protect information in systems and applications and segregates groups of information services, users, and information systems as appropriate. This includes separation of networks for processing, administration and supporting services in case of high protection requirements.
      • SIA applies appropriate protections at the network edge, including stateful firewalls to filter attacks.
      • SIA ensures information involved in electronic messaging will be appropriately protected.
      • SIA information involved in consulting services passing over public networks is protected from fraudulent activity and unauthorized visibility to the extent commercially practical.
      • SIA implements password controls designed to manage and control password strength and usage. Company prohibits users from sharing passwords and accounts.
      • SIA ensures that all remote access to internal networks, systems and applications are protected by multi-factor authentication.
      • SIA protects internal devices utilizing security controls including automated locking screen saver, antivirus software, firewall software, hard disk encryption and appropriate patch levels.
    • Physical security. 
      • SIA ensures physical security perimeters are defined and used to protect areas that contain either sensitive or critical systems and information.
      • SIA ensures secure areas are protected by appropriate entry controls to ensure that only authorized personnel, based on job role, are allowed access.
      • SIA ensures that non-authorized personnel are logged and escorted in areas that contain either sensitive or critical systems and information.
      • SIA ensures that secure areas containing sensitive or critical systems and information monitor for environmental hazards such as heat, fire, and water damage.
    • Secure Software Development Lifecycle. 
      • SIA ensures principles, including such principles similar to Privacy by Design, for engineering secure systems are established, documented, maintained, and applied to any information system implementation efforts.
      • SIA ensures testing of security functionality is carried out during development and that acceptance testing programs and related criteria are established for new information systems, upgrades, and new versions.
      • SIA ensures test data is selected carefully, protected, and controlled.
      • SIA ensures that changes to systems and applications undergo and appropriate change management procedure designed to test, approve, and monitor changes to the SIA environment.
    • Logging and Monitoring.  
      • SIA maintains a central repository of security records and ensures collection of such records from all relevant information technology infrastructure. These logs will be maintained for a minimum of one year.
      • SIA ensures all user access activities, including successful and failed logins, are maintained in the central repository.
      • SIA ensures information security logs are actively monitored and events are reported through appropriate management channels as quickly as possible and will ensure information security incidents are responded to in accordance with the documented procedures.
    • Incident Response.  
      • SIA has an established, documented Information security event response program.  Events are with reported through appropriate management channels as quickly as possible.
      • SIA ensures information security incidents, including privacy related incidents are responded to in accordance with the documented procedures and compliance requirements. SIA will follow documented incident response processes, including notification to the impacted parties without undue delay.
      • SIA ensures the Incident Response process includes a detailed investigation to identify root cause of the event and to document and incorporate lessons learned.
    • Disaster Recovery and Business Continuity.  
      • SIA determines its requirements for information security and the continuity of information security management in adverse situations, e.g., during a crisis or disaster.
      • SIA will document and maintains procedures to maintain business continuity and recover from a disaster.
      • SIA maintains a backup policy to define the organization’s requirements for backup of information, software, and systems.

    CALIFORNIA PRIVACY RIGHTS. 

    If you are a California resident, the California Consumer Privacy Act (CCPA) provides you with additional rights and options regarding your personal information. 

    Right to Access and Right to Know. 

    You can request access to a copy of the personal information that we have about you, including a list of categories of your personal information that we have collected and used over the past 12 months. We will provide to you the following information (to the extent required by law): 

    • The categories of personal information we have collected about you. 
    • The categories of sources from which we collect your personal information. 
    • The business or commercial purpose for collecting or selling your personal information. 
    • The categories of third parties with whom we share your personal information. 
    • The specific pieces of personal information we have collected about you. 
    • The categories of personal information that we have disclosed for a business purpose, along with the category of any other company we shared it with. 
    • The categories of personal information that we have sold, along with the category of any company we sold it to. If we have not sold your personal information, we will say so. 

    Right to Information Portability. 

    You can request the transfer of your personal information to you or to a third party. We will provide to you, or a third party you have chosen, your personal information in a commonly used, machine-readable format. 

    Right to Correct Information. 

    You have the right to request that we correct any inaccurate personal information. 

    Right to Deletion. 

    You have the right to request that we delete the personal information that we have collected and retained, subject to certain exceptions. Once we receive a request, we will delete (to the extent required by law) the personal information we retain about you and direct any service providers to do the same. If we determine that an exception applies, we will inform you of the reason for denying the deletion request. In some cases, deletion may be accomplished through de-identification. 

    Please understand that if you request us to delete your personal information, our subsequent removal of such personal information may impact your ability to use our Services, and may limit your use of or participation in our Services that require your personal information. 

    Right to Opt-Out of Sale of Personal Information. 

    You have the right to opt-out of the sale of your personal information, however, we do not “sell” your personal information as that term is defined under the CCPA. To the extent we change our processing practices or new laws come into effect, we may update this Privacy Policy. 

    Minors. 

    Pursuant to CCPA, Sentry does not share the information of minors under age 16 without their affirmative authorization. 

    Right to Non-Discrimination. 

    We will not discriminate against you for exercising any of your CCPA rights. This generally means we will not deny you goods or services, charge different prices or rates, provide a different level of service or quality of goods, or suggest that you might receive a different price or level of quality of goods. 

    Verification of Requests. 

    Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. The CCPA requires that we verify the identity of each person who makes a request to know what personal information we have about you or to delete the personal information we have about you. 

    You may request this information no more than two times in a rolling twelve-month period. When you make this request, the information provided may be limited to personal information we collected about you in the previous 12 months. 

    All requests must provide sufficient information to allow us to reasonably verify you are the person whom we collected personal information about or an authorized representative of such person. We will only use the information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request. Please describe your request with sufficient detail to allow us to properly respond to it. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. 

    Shine the Light Request. 

    California Civil Code § 1798.83 permits residents of California to request from Sentry a notice disclosing: (1) the categories of personal information we have shared with third parties, if any, for the third parties’ direct marketing purposes, during the preceding calendar year, and (2) the names and addresses of those third parties.
